Informed Consent, Assumption of Risk, Release of Liability and Waiver of Claims

1. Agreement

This is a binding legal agreement. Please clarify any questions or concerns before agreeing.

This agreement applies to all participants, regardless of age, who participate in activities organized, sanctioned, or delivered by Petrie Island Canoe Club. Where the participant is under the age of majority, this agreement is entered into by the participant and their parent or legal guardian, collectively referred to as the “Participant.”

Petrie Island Canoe Club activities include, but are not limited to, events, races, training, competitions, trials, festivals, regattas, camps, workshops, and clinics (collectively, the “Activities”).

2. Disclaimer

Petrie Island Canoe Club, its trainers, instructors, agents, staff, volunteers, directors, and representatives (collectively, the “Organization”), as well as its affiliated Provincial Associations and National Association (collectively, the “Affiliates”), are not responsible for any injury, personal injury, damage, property damage, expense, loss of income, or loss of any kind suffered by a Participant during, or as a result of, participation in the Activities, including but not limited to negligence of the Organization or its Affiliates.

3. Description of Risks

Participation in the Activities is voluntary. The Participant acknowledges awareness of the risks, dangers, and hazards associated with the Activities, including but not limited to injuries arising from:

  • Hazards particular to paddling and related activities
  • Executing strenuous and demanding physical techniques
  • Water hazards, terrain obstacles, waves, unstable surfaces, and extreme weather conditions
  • Vigorous physical exertion, strenuous cardiovascular activity, and rapid movements
  • Exerting and stretching various muscle groups
  • Failure to properly use equipment or mechanical failure of equipment
  • Contact, collision, falling, or being struck by other participants or equipment
  • Blunt force trauma, serious soft tissue injuries, broken bones, or spinal cord injuries, which may result in permanent paralysis
  • Surface abrasions, entanglements, entrapments, or flying objects and debris
  • Drowning, including but not limited to equipment failure, entanglement, falling from a boat or watercraft, capsizing, or being rendered unconscious in the water
  • Cold water conditions resulting in hypothermia

4. Acknowledgement of Conditions

The Participant acknowledges and agrees that:

  • An approved personal flotation device must be worn on the water, except where government regulations provide exemptions
  • Injuries sustained may be severe
  • Anxiety may be experienced during activities and programs
  • Close contact with other participants may occur
  • The risk of injury is reduced by following all rules established for participation
  • The risk of injury increases as fatigue increases

5. Release of Liability and Assumption of Risk

In consideration of being permitted to participate in the Activities, the Participant agrees:

  • That the Participant’s physical condition has been verified by a medical doctor to be adequate for participation
  • That sole responsibility for the Participant’s safety remains with the Participant
  • To remove themselves from participation if they observe unsafe conditions or feel unable or unfit to continue safely
  • To freely accept and fully assume all risks associated with participation, including the possibility of personal injury, death, property damage, expense, or loss of income

The Participant waives, releases, and forever discharges the Organization and its Affiliates from any and all claims, demands, actions, damages, losses, costs, or expenses (including legal fees), arising out of or related to participation in the Activities, including claims arising from negligence, gross negligence, negligent rescue, omissions, breach of contract, or breach of statutory duty of care.

6. Electronic Acceptance and Binding Effect

By selecting the required checkbox during registration, the Participant confirms that:

  • They have read and understand this agreement
  • They are agreeing voluntarily
  • They understand this agreement is legally binding

This agreement is binding upon the Participant and, where applicable, their parent or legal guardian, as well as their heirs, executors, administrators, and legal representatives.
